The Overseas Private Investment Corporation (OPIC) is the U.S. Government"s Development Finance Institution. OPIC"s mission is to provide loans, guaranties, political risk insurance, and investment funds to assist American businesses expand into emerging markets.

This is a notice issued as required by FAR 5.203. Because the procurement will be for commercial services and have a not-to-exceed value of below the $7000000, OPIC awarded a sole source contract under the authority of FAR 13.501(a)(1). This action is to increase the ceiling in the amount of $150000 to $332000 under the current contract.

The requirement for legal counsel to represent OPIC in connection with a project borrower affiliated with the Summit Hotels Limited/Summit Global Group is ongoing. This contract constitutes a completion effort, which due to an unforeseeable change of course in the litigation, conditions for consent were re-vamped. In order to complete the services required under this contract, those conditions needed to be accommodated in the legal proceedings. It is essential for OPIC to engage this law firm that has the existing (non-severable) contract, knowledge of and experience with this transaction in order to facilitate an orderly and swift closing to minimize risk of serious financial injury to OPIC in its recovery prospects under its project loan.

The North American Industry Classification System (NAICS) code for this requirement is 541110 with the size standard of $11 million. This notice of intent is not a request for proposals or quotes. At this time no capable sources may submit statements of capabilities.

A determination by the Government not to open the requirement to competition based upon the justification attached and is solely within the discretion of the Government. Information received will not be considered as this is not a competitive contract action.
